Terms of Service

• "Account Information" means information about you that you provide to us in connection with the creation or administration of your DarkerDB account, including usernames, email addresses, Discord information, and billing information.
• "API" means the application programming interface provided by DarkerDB.
• "Content" means software, data, text, audio, video, images, or other materials.
• "Dark and Darker" means the video game developed and published by Ironmace.
• "DarkerDB Content" means APIs, database information, market data, player information, and any other Content made available by us related to use of the Services or on DarkerDB.com.
• "GrimVault" means the desktop overlay application that provides Dark and Darker item information.
• "Ironmace Content" means any Content related to Dark and Darker that is owned by Ironmace.
• "Services" means collectively the DarkerDB.com website, API, and GrimVault application.
• "Service Plan" means the specific tier of service access (Apprentice, Champion, or Warlord) that you have selected.
• "Third-Party Content" means Content made available to you by any third-party on DarkerDB.com or in conjunction with the Services.

DarkerDB.com provides database and API services containing information related to the game Dark and Darker. Our Services include:

• Access to game data, market information, and related statistics through our website
• API access to this information for developers
• GrimVault, a desktop overlay application that provides real-time information about in-game items

The Services are offered under three plans:

• Apprentice Plan: Free access with basic features and limited API usage
• Champion Plan: Paid subscription with enhanced features for players
• Warlord Plan: Paid subscription with increased API rate limits for developers

4.1 Website and API License

Subject to your compliance with the terms and conditions of this Agreement, DarkerDB grants you a limited, non-exclusive, non-transferable, revocable license to access and use the DarkerDB.com website and API services in accordance with your Service Plan.

4.2 GrimVault License

Subject to your compliance with the terms and conditions of this Agreement, DarkerDB grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the GrimVault application in accordance with your Service Plan.

4.3 API Usage

Your use of the API is subject to rate limits based on your Service Plan. You must include your API key with all requests. You may not share your API key with any third party. We reserve the right to monitor your API usage to ensure quality, improve our Services, and verify your compliance with this Agreement.

4.4 Ownership

All game-related content, including but not limited to game mechanics, artwork, names, and descriptions, is owned by Ironmace. All other aspects of the Services, including the database structure, API, and GrimVault application, are owned by DarkerDB. This Agreement does not grant you any rights to use any Ironmace intellectual property or DarkerDB intellectual property except as explicitly stated in this Agreement.

5.1 Service Plans

Access to certain features of the Services requires payment according to your selected Service Plan. The Apprentice Plan is provided free of charge. The Champion and Warlord Plans require payment of the applicable subscription fees.

5.2 Payment Terms

All payments are processed through Stripe. By subscribing to a paid Service Plan, you authorize us to charge your payment method for the subscription fee on a recurring basis until you cancel your subscription. You agree to maintain accurate and current payment information.

5.3 Refunds

All fees are non-refundable unless otherwise required by applicable law. We reserve the right to change our pricing and subscription plans with 30 days' notice.

5.4 Taxes

You are responsible for all taxes applicable to the fees paid by you, except for taxes based on our net income.

6.1 General Restrictions

When using the Services, you shall not:

• Violate any applicable laws or regulations
• Share your account credentials or API key with any third party
• Attempt to reverse engineer, decompile, or disassemble any portion of the Services
• Use the Services in any way that could damage, disable, or impair the Services
• Use any automated means to access the Services without our permission
• Attempt to gain unauthorized access to any part of the Services
• Use the Services to collect or harvest any information about other users
• Use the Services for any illegal, fraudulent, or unauthorized purpose

6.2 API Usage Restrictions

In addition to the general restrictions, when using the API, you shall not:

• Exceed the rate limits associated with your Service Plan
• Sell, resell, or lease access to the API unless explicitly authorized by us
• Create an application that functions substantially the same as the API or competes with it
• Use the API in a manner that adversely impacts the stability of DarkerDB servers or other users' ability to use the Services

6.3 GrimVault Usage Restrictions

When using GrimVault, you shall not:

• Modify or create derivative works based on GrimVault
• Use GrimVault to modify game files or game memory
• Use GrimVault to automate any aspect of gameplay
• Distribute or provide access to GrimVault to any third party

We collect and process certain personal information when you use our Services. This includes:

• IP addresses for session management and logging purposes
• Email address, Discord username, and Discord guild information if you log in using Discord OAuth
• Payment information processed through Stripe
• Log files automatically uploaded by GrimVault
• Standard analytics data collected through Google Analytics

We use cookies for session management (PHPSESSID) to maintain your login state.

We do not share your personal information with third parties except as necessary to provide the Services (e.g., payment processing through Stripe) or as required by law.

8.1 Term

This Agreement will remain in effect until terminated by either you or DarkerDB.

8.2 Termination by You

You may terminate this Agreement at any time by ceasing to use the Services and, if applicable, canceling your subscription.

8.3 Termination by Us

We reserve the right to terminate or suspend your access to the Services at any time for any reason without notice, including but not limited to:

• Violation of any provision of this Agreement
• Repeated exceeding of API rate limits
• Engaging in any activity that disrupts or impairs the Services
• Failure to pay applicable fees
• Upon request from Ironmace
• If we decide to discontinue the Services or any part thereof

8.4 Effect of Termination

Upon termination:

• Your right to access and use the Services will immediately cease
• You must uninstall and cease using GrimVault
• If terminated by us for cause, no refunds will be provided for any prepaid but unused subscription period
• Sections of this Agreement that by their nature should survive termination will survive termination

9.1 Service Availability

The Services are provided on an "as is" and "as available" basis. We do not guarantee that the Services will be uninterrupted, timely, secure, or error-free. We reserve the right to modify, suspend, or discontinue the Services or any part thereof at any time without notice.

9.2 Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DARKERDB EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTY THAT THE SERVICES WILL MEET YOUR REQUIREMENTS OR THAT THE SERVICES WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED.

9.3 Game Data Accuracy

While we strive to provide accurate information, we do not guarantee the accuracy, completeness, or timeliness of any game data, market information, or other content provided through the Services. Game data may be delayed or contain errors.

9.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DARKERDB BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (iii) ANY CONTENT OBTAINED FROM THE SERVICES; OR (iv) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATING TO THIS AGREEMENT IS LIMITED TO THE AMOUNT YOU PAID US TO USE THE SERVICES DURING THE 12 MONTHS PRECEDING THE CLAIM.

You agree to defend, indemnify, and hold harmless DarkerDB, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees and costs, arising out of or in any way connected with your access to or use of the Services, your violation of this Agreement, or your violation of any rights of another.

DarkerDB is not affiliated with, endorsed by, or officially connected to Ironmace or Dark and Darker. All game content, including items, images, names, descriptions, and other game data, is the property of Ironmace.

While GrimVault has received private approval from Ironmace, we make no guarantees about future compatibility or approval. If Ironmace requests that we modify or cease any aspect of our Services, we will comply with such requests, which may result in changes to or termination of the Services without notice.

This Agreement shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions. You agree that any legal action arising out of or relating to this Agreement shall be filed exclusively in the state or federal courts located in Washington, and you consent to the personal jurisdiction of such courts.

13.1 Entire Agreement

This Agreement constitutes the entire agreement between you and DarkerDB regarding the Services and supersedes all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning its subject matter.

13.2 Severability

If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent possible under law.

13.3 No Waiver

Our failure to enforce any right or provision of this Agreement will not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of DarkerDB.

13.4 Assignment

You may not assign or transfer this Agreement, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer this Agreement without such consent will be null and void. We may assign or transfer this Agreement without your consent.
